On January 14, 2025, the Government of Canada announced significant changes to the eligibility for Open Work Permits (OWPs) for family members of international students and foreign workers. These updates, set to take effect on January 21, 2025, aim to align Canada’s temporary residence programs with the country’s economic and labor market priorities while maintaining the integrity of the immigration system.
What Are the Changes?
International Students
Starting on the implementation date, OWPs for family members will be limited to spouses of international students who meet the following criteria:
Eligible Programs:
- Master’s programs lasting 16 months or longer.
- Doctoral (PhD) programs.
- Select professional programs.
Foreign Workers
Spouses of foreign workers will be eligible for an OWP if the worker meets these requirements:
Eligible Occupations:
- Jobs classified under TEER 0 or 1 of Canada’s National Occupational Classification (NOC) system.
- TEER 2 or 3 occupations in sectors facing labor shortages or aligned with government priorities, including natural sciences, construction, healthcare, education, sports, and natural resources.
Work Permit Duration:
- The foreign worker must have at least 16 months remaining on their work permit when the spouse applies for the OWP.
Key Change:
Dependent children of foreign workers will no longer qualify for OWPs under these updated measures.
Renewals of Existing Permits
Work permits issued before January 21, 2025, will remain valid until their expiration date. Additionally, family members already in Canada can apply to renew their work permit under these conditions:
- The application follows the same criteria as the existing permit.
- The requested renewal duration aligns with the principal applicant’s valid study or work permit.
Exceptions
Some workers and their families will not be affected by these changes, including:
- Spouses of workers covered by free trade agreements.
- Spouses of workers transitioning to permanent residence.
Family members no longer eligible for an OWP under the new rules may explore other types of work permits available through Canada’s programs.
